The terms for using our store.

These Terms of Service ("Terms") govern your use of the Wave Bye website and online store (together, "the Site"), operated by Wave Bye Inc ("Wave Bye," "we," "us"). Wave Bye sells non-hormonal, over-the-counter period care — including our drug product and dietary supplements — through our Shopify storefront. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site. We've written these Terms to be readable, because terms you can't understand protect no one.

The Site provides information about our products and educational content about menstrual health. Reading it, using our tools, or buying our products does not create a physician–patient relationship and is not a substitute for professional medical advice. Our products are intended to support your own care choices, and they are not designed to diagnose, treat, cure, or prevent any disease or condition beyond their labeled use.

If you are experiencing severe, sudden, or concerning symptoms — including severe pelvic pain, heavy bleeding with dizziness or fainting, chest pain, or difficulty breathing — stop reading and seek emergency care or talk to a licensed clinician who knows your history. Nothing on this Site is monitored for emergencies.

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to place an order on the Site. If you are younger, a parent or legal guardian must place the order for you. By placing an order, you represent that the information you provide (billing, shipping, and contact details) is accurate and that you have the legal authority to make the purchase and use the payment method you provide.

Wave Bye offers a range of non-hormonal, over-the-counter period care products, including our foundational drug product and dietary supplement formulations. Each product is clearly labeled with its ingredients and intended use, and you should read the label, the included instructions, and the Drug Facts or Supplement Facts panel before use.

A note on supplements: our dietary supplements have not been evaluated by the Food and Drug Administration, and are not intended to diagnose, treat, cure, or prevent any disease. Product descriptions and statements about supplements reflect how the ingredients are generally understood to work, and may not be evaluated by the FDA. Our drug product is regulated and sold in accordance with applicable law.

We make every effort to display product information, photos, and pricing accurately, but minor variations (for example, in color or on-screen size) can occur. We reserve the right to correct errors, update product information, and refuse or limit orders where we reasonably believe required.

You agree not to: use the Site for any unlawful purpose; attempt to access accounts or systems that aren't yours; scrape, harvest, or bulk-download Site content or data; upload malicious code; impersonate any person; interfere with the Site's operation; misuse discount codes; or otherwise use the Site in a way that harms us, our customers, or our systems. We may suspend or cancel accounts and refuse orders for violations.

The Site and its content — text, graphics, logos, the Wave Bye name and marks, product images, and our educational materials — are owned by Wave Bye Inc or licensed to us, and are protected by copyright and trademark law. You may view, download, and print Site content for your personal, non-commercial use, keeping all notices intact. Anything else — republishing, commercial use, or training automated systems on our content — requires our written permission.

We rely on trusted third-party services to operate the Site, including Shopify (our e-commerce platform and hosting), our payment processor, and our shipping partners. Those services have their own terms and privacy practices, which govern your use of them (for example, Shopify's Terms of Service). We're not responsible for third-party sites or services we don't control, and by using them you agree to their terms.

We work hard to keep the Site accurate, available, and useful, but we provide it "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties about the Site — express or implied, including merchantability, fitness for a particular purpose, and non-infringement — and we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Product-specific warranties and disclaimers, and any legally required statements, appear on the product itself and its packaging. Results vary by person, and no one can honestly guarantee a particular health outcome; we promise to make products to spec and to stand behind them, which is different from promising a result.

To the fullest extent permitted by law, Wave Bye Inc and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products, and our total liability for Site-related claims is limited to the greater of $100 or the amount you paid us in the twelve months before the claim.

Nothing in these Terms limits or waives any right you have that cannot be limited or waived under applicable law, including any consumer-protection rights that apply where you live. Where law requires a higher standard with respect to a particular product, that standard controls.

You agree to indemnify Wave Bye Inc against claims and costs (including reasonable attorneys' fees) arising from your violation of these Terms or your unlawful use of the Site. This section does not apply to your good-faith use of the Site or to any product liability claim governed by product-safety law.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes about the Site will be resolved in the state or federal courts located in Delaware, and you and we each consent to their jurisdiction — except that you may bring claims in your local small-claims court where applicable law permits. Before filing anything, contact us — most problems are misunderstandings, and we resolve them quickly.

We may update these Terms as the business evolves; the "last updated" date at the top of this page will change, and meaningful changes will be noted here. Continued use of the Site after changes means you accept them. If any provision is found unenforceable, the rest remain in effect. These Terms plus the Privacy Policy are the entire agreement about your use of the Site and our products.

We want the Site usable by everyone. If you encounter an accessibility barrier, tell us at hello@wavebye.co and we will work to fix it and to get you the information you needed another way in the meantime.
